"Police will begin random searches of bags and packages carried by people entering city subways, officials announced Thursday after a new series of bomb attacks in London. Passengers carrying bags will be selected at random before they pass through turnstiles, and those who refuse the police request won't be allowed to ride, Police Commissioner Raymond Kelly said.

He said officers posted at subway entrances would not engage in racial profiling, and that passengers are free to 'turn around and leave.'"

As long as the searches are (at least in theory) random, then they comport with 4th amendment law (at least federal law, I'm not familiar with the state law of New York). If a defendant can prove profiling, or unconstitutional use of the laws (say to target criminals on whom the police don't have enough to get a search warrant) as an end around the warrant requirement, then you may get the law struck down. Util then, cars give people less of an expectation of privacy than almost any other vehicle. Crazy, no?

I don't think it's right. I don't give a damn what they say. I know that everyone disagrees with me, but I don't think whittling away at our civil liberties and everyday freedom and treating us all like criminals is the answer.

Luckily, I live in the South. Here, the word "commute" still means an automobile, typically a truck. I'm grateful, because I don't want some troppers pudgy fingers routing through my purse.
